What’s an Agency, What’s a Registry? – The Different Options for Private Duty Home Health Care in Florida and Other Nuisances

Whether clients pay privately or use private funds, there are options in Florida. Florida is one of the only States in the nation to regulate the two main types of providers. An analysis of the types of providers along with the financial and legal aspects of using these providers will be discussed.

Marc Spector, Esq. is President and CEO of Best Care, a family owned private duty nursing company started in 1980. Marc joined Best Care in 2002 after leaving a prominent South Florida litigation firm, where he practiced insurance litigation for 5 years. He is the head of Best Care’s legal, corporate development and A/R departments. He is also the administrator of the company’s flagship office in Miami. Marc is a Florida native and received his undergraduate degree from the University of Florida and his JD, Cum Laude, from Nova Southeastern University, where he was a member of Phi Delta Phi honor fraternity. He has been a licensed Florida attorney since 1997, and in addition, is admitted to practice in both the Southern and Northern U.S. District Courts.

Higher top tax rates, the new 3.8% Medicare surtax, and limits on itemized deductions are recent tax code changes that underscore the current significance of tax-conscious investment management for higher-income taxpayers and fiduciaries. As an estate planning practitioner, you can employ proactive and appropriate strategies to mitigate the impact of increased tax liability without disrupting the overall plan for high net worth clients and their families. This session will highlight practical planning opportunities and possible year-end 2016 and 2017 wealth transfer strategies.

Philip Herzberg delivers strategic financial planning advice to high net worth individuals and families as a Client Advisor for The Lubitz Financial Group. He is a Certified Financial Planner® professional, Certified Trust and Financial Advisor, and Accredited Estate Planner® designee with nearly a decade of professional experience. Serving on The Lubitz Financial Group's Financial Planning and Advisory Committees, Philip utilizes this experience to help clients implement tax-efficient investment, retirement, and estate planning strategies. Prior to joining The Lubitz Financial Group, Philip was a Relationship Manager at United Capital and Client Services Manager at Ladenburg Thalmann.  A Northwestern University graduate with a Bachelor of Science in Speech with departmental honors, he earned a Master of Science in Finance from Florida International University with a graduate certificate in Investments. Recognized as a devoted ambassador to his profession, Philip is the Immediate Past President of the Financial Planning Association (FPA®) of Florida, Past President of the FPA of Miami, and is Secretary of the Executive Board of Directors of the Estate Planning Council of Greater Miami. Care and Feeding of the Acronyms – The Funding, Administering, Reporting and Repairing of GRATs, QPRTs and IDGT Sales

This session will examine how to properly fund and administer GRATs, QPRTs and IDGT sales.   We will discuss the proper reporting of GRAT and QPRT funding on gift tax returns, review the IRS adequate disclosure rules for IDGT sales and provide guidance regarding income tax reporting and related tax compliance issues.  We will also review how to “immunize” GRATs, refinance IDGT notes and ways to reacquire low tax basis assets held in GRATs and QPRTs.  The presentation will also examine how to recognize and repair defective and poorly-administered GRATs.
